Terms of Service
Last updated 2026-10-21
These terms are an agreement between you and Alexein (“we”, “us”) for the use of twin memory: the API at api.twinmemory.dev, the hosted MCP server, the developer console and the documentation (together, “the Service”). If you accept them for a company, you confirm you may bind it, and “you” means that company.
1. Your account and keys
You need an account to get an API key. Keep keys secret: anything done with your key is done by you. We show a key once and store only its digest, so we cannot recover a lost key; revoke it in the console and make another. Tell us at once at security@twinmemory.dev if you believe a key or your account has been compromised.
2. Your content
“Customer Content” is what you or your end users send to the Service: items you add, queries you search, and what memory derives from them. You own it. You grant us the rights we need to host, process and return it to you in order to run the Service, and for no other purpose. We do not use Customer Content to train models.
You are responsible for having the right to send us Customer Content, including any notice to and consent from your end users that the law requires. Where Customer Content includes personal data, our Data Processing Agreement applies and forms part of these terms.
3. Acceptable use
You will not, and will not let anyone else:
- use the Service to break the law or to infringe anyone’s rights;
- send content you have no right to process, or malware;
- probe, scan or test the Service’s security except as our disclosure policy allows;
- try to reach another customer’s or end user’s memory, or get around rate limits or plan limits;
- resell the Service as a standalone memory API without a written agreement with us.
We may suspend access that puts the Service or other customers at risk, and will tell you why.
4. Plans, limits and payment
Plans and their limits are set out on the pricing page. Paid checkout is not open yet; until it is, every account is on the Free plan and no payment is taken. When paid plans open, fees are charged monthly in advance, are exclusive of taxes, and are not refundable except where the law requires. We will give at least 30 days’ notice of a price change to a plan you are on.
5. Erasure and export
You can erase any item, session or end user at any time through the API or the console, and the Service returns a receipt of what was removed. When your account closes we delete Customer Content within 30 days, except where the law requires us to keep it.
6. Changes to the Service
The Service changes; the changelog records how. We will not remove a generally available API route without at least 90 days’ notice. Features marked “Soon” are not part of the Service until they ship.
7. Confidentiality and security
Each party keeps the other’s non-public information confidential and uses it only for this agreement. We protect Customer Content with the measures described on our security page and in the DPA.
8. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Beyond that, and to the extent the law allows, the Service is provided “as is”. Memory derives facts from what it is given using language models, and a derived fact can be wrong; every result carries the source it came from so that you can check it.
9. Liability
Neither party is liable for indirect or consequential loss, or loss of profit, revenue or data, arising from this agreement. Each party’s total liability is limited to the fees you paid us in the 12 months before the claim, or USD 100 if you paid nothing. These limits do not apply where the law forbids them.
10. Ending the agreement
You may stop using the Service and close your account at any time. We may end these terms on 30 days’ notice, or at once if you materially breach them. Sections 2, 8, 9 and 11 survive.
11. General
These terms are governed by the laws of [jurisdiction to be confirmed]. We may update them; we will post the new version here and, for a material change, email you at least 30 days before it takes effect. Questions go to legal@twinmemory.dev.
